I'd say check the hunting regulations in your state. Many states require a minimum caliber, but some also specify a minimum amount of "energy" delivered at a certain yardage.
You can check in a Remington catalog. It's listed in there, showing all the stats.....velocity, energy, bullet drop, etc.
If I was going to use that cartridge, I'd want to be REAL close.

mine will put a factory Remington round through 2 layers of trunk lid at 100yds
the second hole is considerably larger than the first
I wouldn't hesitate on dear up to 100yds...that cartridge packs a fair wallop,
although
I could hear the bullet strike as the report faded so it's no speed demon...being a revolver round and all.

Even more handy in carbine form (although this is 38-40 caliber). I'd second the 100 yard limit.

Your profile doesn't show what state you live in. At least I couldn't find it. I killed my first buck in Michigan with a .357 mag handgun. I would not have used that weapon in Wyoming. I killed quite a few whitetails in Michigan; all closer than 100 yards. Most were near 30 yards. If your targets are under 100 yards and you can shoot the 44-40 with some degree of accuracy, I'd say it is fine assuming it's allowed in your state.

i have a rem. 14-1/2 carbing with the thumb nail safety and saddle ring in 44-40 that i have killed deer with,23grs imr 4227 and a 200gr hornady bullet. when shot thru the lungs they don,t go far. eastbank.
